WARRANTY POLICY

THE LIMITED 12-YEAR WARRANTY

We provide the components of our products with a LIMITED guarantee that shall be effective for up to ten years for the main structural frame and five years for ancillary parts such as the opening and closing mechanisms.

To benefit from the limited warranty, the original purchaser ("Customer") must complete the installation of our products by following the provided manual. The limited warranty applies from the installation date, subject to registration of all the products as indicated under "warranty registration" below.

In all cases, the warranty is limited to the price paid for the products.

LIMITED WARRANTY

This limited warranty applies only within the United States. This limited warranty gives you specific legal rights and you may also have other rights, which vary from state to state.

We warrant that during the warranty period, the product(s) will be free from defects in material and workmanship.

To the extent not prohibited by law, this warranty is exclusive and in lieu of all other warranties, oral, written, statutory, express or implied. Except for the express warranties contained in this limited warranty statement and to the extent not prohibited by law, we disclaim all other warranties, expressed or implied, statutory or otherwise, including without limitation, the warranties of merchantability and fitness for a particular purpose. Some states do not allow disclaimers of implied warranties, so this disclaimer may not apply to you. To the extent such warranties cannot be disclaimed under the laws of your jurisdiction, we limit the duration and remedies of such warranties to the duration of this express limited warranty.

Our responsibility for defective goods is limited to product replacement, repair or refund of purchase price, as described below in this warranty statement.

WHO IS THE WARRANTOR?

LUXPATIO INC (“Luxpatio”), located at 2605 Technology Dr, Ste 300, Plano, TX 75074 provides this up to 12-year limited warranty to the initial purchaser of products sold by Luxpatio (hereinafter referred to as the “Products”).

WARRANTY REGISTRATION

The purchaser is automatically registered for their warranty from the moment of delivery. The original receipt serves as a warranty certificate

WARRANTY CONDITIONS

This warranty is non-transferable and valid only for the original purchaser in the USA. It covers the original purchase price or replacement of parts, with the Customer responsible for the installation of any replacement components.

THE LIMITED 12-YEARS WARRANTY EXCLUSIONS

1. Damage due to acts of God or force majeure, including without limitation: change of color caused by sun and salt, any damage resulting from smoke, fire, exceptional climatic conditions such as, without limitation, deep frosts, heavy snow, violent winds, lightning, heavy rain, black ice, hail, hurricanes, ground movement, flooding, overflow of any stream, as well as vandalism.

2. Damage, direct or indirect, resulting from the negligence of the Customer, improper maintenance, or improper use of the product, including, without limitation, a source of direct or indirect heat, deletions, modifications, or additions made by the Customer, and any weight load on the louvers and the structure of the products.

3. Direct or indirect damage resulting from incorrectly following the installation manual.

4. Damage, direct or indirect, resulting from installation or improper storage, maintenance, or use by any person who does not meet the guidelines referred to by the Installation Manual and Maintenance Guide.

5. When the product is installed on a concrete slab or other surface and is damaged, direct or indirect, resulting from movements in such a concrete slab or surface.

6. The installation of the structure after one year following the date of installation.

7. Any motor(s), lights, and electrical parts, if any, are installed with the product.

8. To the assembly and the efficiency of the components when the installation is not done by not following the installation manual correctly.

9. Direct or indirect damage that may be caused by the Customer's structure on which the product has been installed.

10. Runoff or water infiltration between the wall and the product in the case of an installation attached to a building. Our products are a free-standing construction and should not be attached to the buildings.

11. The cost of packing, dismantling, storage, transport, and handling the products.

OTHER CONDITIONS AFFECTING THE LIMITED 12-YEARS PERGOLA WARRANTY

Application of the limited warranty shall be suspended without notice or delay if the Customer or Reseller has financial obligations in default to products and shall remain suspended until the Customer or Reseller has met these financial obligations to the satisfaction of Products. Buying a product's replacement part does not have the effect of extending the length of the limited warranty.

WARRANTY CLAIMS

Any claims under this limited warranty must be made in writing and received by email at support@luxpatio.com within 30 days of discovery of the defect. The written notification must include the name and address of the Customer, a detailed description of the defect, photos to support the claim, the date of installation, the date the defect was discovered, the address where the product is installed, the name of the installer, and the address of the reseller and a copy of the invoice.

LUXPATIO INC (“Luxpatio”) will have the right to inspect the structure and the product upon receipt of a warranty claim. Repairs are to be avoided before the inspection by Luxpatio. Any repairs or alterations to the product before an inspection may void the limited warranty at the Luxpatio's sole discretion.

After inspection, if Luxpatio determines that the limited warranty is applicable, Luxpaito, at its sole discretion and expense, will replace or repair the product or refund any amount paid by the Customer for the purchase of the Luxpatio product, all within 30 days of receipt of the warranty claim.

The Customer must pay all labor charges generated by Luxpatio after one year following the installation date.

In case of replacement of the product, if the same product is no longer available, it will be replaced by a product of equal value to the initial purchase value of the product being replaced.

WARNING

This written limited warranty is considered an official document and replaces all previous warranties and conditions, written or verbal, mentioned or given to the Customer by LUXPATIO INC (“Luxpatio”).

Luxpatio will not be held responsible, in any case, for the replacement cost of another product or for any direct or indirect operating loss.

THE WARRANTY FOR ACCESSORIES

The motor and its applications, lights, heaters, and electrical elements are guaranteed for two years from the effective date of the limited warranty if purchased simultaneously with a product. Lights, heaters, and electrical elements are guaranteed for two years from the purchase date when purchased separately.

THIS WARRANTY IS NOT A PERFORMANCE CLAIM. THIS LIMITED WARRANTY APPLIES ONLY WITHIN THE UNITED STATES.

GOVERNING LAW/VENUE

This Limited Warranty shall in all respects be governed by the laws of Texas, US. This Limited Warranty Policy is effective as of May 10, 2025

BINDING ARBITRATION

Any dispute, claim or controversy between you and Luxpatio arising out of, or related to, this Product(s) Limited Warranty is subject to binding arbitration on an individual basis in accordance with the terms mentioned in the Terms of Purchase on Luxpatio’s Website.
